Davis & Ferris organ named National Historic Landmark

On January 11, the United States Secretary of the Interior Sally Jewell announced 24 new National Historic Landmarks. The National Historic Landmarks Program recognizes historic properties of exceptional value to the nation and promotes the preservation efforts of federal, state, and local agencies and Native American tribes, as well as those of private organizations and individuals. For the first time, a pipe organ (rather than a building housing a pipe organ) has been named a national historic landmark.

The instrument is the 1846–47 Davis & Ferris organ originally installed in Calvary Episcopal Church, New York, New York, and now in the Round Lake Auditorium in Round Lake, New York. (The entire village of Round Lake was listed on the National Register in 1975.) The organ was moved from New York City to Round Lake in 1888, where it has remained since. While some slight alterations were made to the instrument between 1852 and 1878, no further alterations have occurred, save for addition of an electric blower. The organ comprises three manuals. four divisions. 33 stops. 33 registers. 41 ranks, 2084 pipes. Manual compass is 58 notes; Pedal compass 25 notes. The organ is maintained by Andover Organ Company.

Two Casavant Organs, Seventy-Five Years

Situated on a hill overlooking the city of Lewiston, Maine, the Gothic Basilica of Saints Peter and Paul is visible from a great distance in any direction. Its grand architecture beckons visitors from all over. The interior of the basilica is as sumptuous as its exterior. And among the many treasures of the edifice are the organs.

Lewiston was founded in 1795 along the Androscoggin River. Its industry was supported by cotton mills for many years. By the 1850s the Bates Mill, named for Benjamin E. Bates, for whom Bates College is also named, became the largest employer in Lewiston, remaining so for a century. In the late 1850s, French Canadians began to migrate to Lewiston for job opportunities. A section of Lewiston became known as “Little Canada,” and the city has celebrated its French Canadian character to this day.

Various Protestant congregations were formed, but it would be 1857 before the first Catholic parish, Saint Joseph, was founded. The parish, which was English speaking and serving primarily Irish immigrants, laid the cornerstone for a church along Main Street on June 13, 1864, and finished construction in 1867. The architect was Patrick C. Keely.

The Catholic Bishop of Portland assigned the Reverend Louis Mutsaers to minister to the French-speaking Catholics of Saint Joseph Church. With more than 1,000 souls in the French-speaking Catholic community, Saint Peter Church was founded in 1870, the first French ethnic parish in the diocese. Father Edouard Létourneau of Saint-Hyacinthe, Québec, was named first pastor. The fledgling congregation moved to Saint John Chapel, the second floor of a house on Lincoln Street, coincidentally the first home of Saint Joseph Church. The first Mass, a wedding, was said on July 2, 1870. The Reverend Pierre Hévey became pastor the following year.

 

The first church

Father Hévey constructed a Gothic church building on Ayers Hill, on Bartlett Street between Ash and College Streets. The cornerstone was laid July 7, 1872, and the edifice was dedicated on May 4, 1873. The substantial building was 116 feet long, 32 feet wide, and crowned by a 160-foot bell tower. The total cost of the building, including land and furnishings, was approximately $100,000. The dedication Mass, attended by 2,000 and presided over by the Bishop of Portland, also witnessed the confirmation of 215 children. The parish school was opened in 1878, and a cemetery was developed. The Sisters of Charity of Saint-Hyacinthe would also establish a hospital, an orphan asylum, and a home for the aged, in addition to teaching in the school. A five-story brick school building accommodating 700 students was opened in 1883 at Lincoln and Chestnut Streets. A second school, for boys, was opened on Bates Street in 1887. By the close of the century, there were 1,721 students in the parish schools.

When Father Hévey left the parish in 1881, administration was turned over to the Dominican Fathers of Lille, France. About this time, Saint Peter became known as Saints Peter and Paul Church. By the late 1890s, church membership neared 10,000 persons, and galleries were added to the church nave, and the building’s basement was enlarged. A brick monastery was built for the Dominicans on Bartlett Street, a building that still stands behind the basilica today. The Dominicans would live here until they returned the parish to the diocese in 1987.

In 1902, Saint Louis Church was founded in Auburn, across the river, but this did little to lessen overcrowding at Saints Peter and Paul Church. In 1904, Father Alexandre Louis Mothon, OP, then pastor of the parish, retained Belgian-native Noël Coumont of Lewiston to design a neo-Gothic edifice to be built of Maine granite at an estimated cost of $250,000. Portland diocesan authorities were duly impressed with Coumont’s work and named him diocesan architect.

 

Building the present church

The final Mass in the old church was celebrated on February 5, 1905, after which the building was dismantled and demolished. A temporary wooden structure seating 1,200 persons was erected. Adjacent property was acquired, and construction of the lower church was commenced on February 22, 1906. Despite the collapse of a wall on November 9, the lower church was in use for Midnight Mass at Christmas, December 25, 1906. Father Mouthon had resigned and was replaced by the Reverend Antonin Dellaire, OP.

The parish would not complete the upper church for another three decades. In the interim, the diocese created three other parishes in Lewiston: Saint Mary, founded in 1907 in “Little Canada” with 820 families; Holy Family, founded in 1923; and Holy Cross, founded that same year with 575 families.

The diocese granted the Reverend Mannès Marchand, OP, pastor, permission to complete the upper church in 1933. A bid of $361,510 was accepted in April of the following year. Timothy G. O’Connell of Boston had become architect. Construction began in May, and the project would require some 516 boxcars of granite. Slate, copper, and limestone support the roofs.

The exterior was completed in 1935, crowned by twin steeples rising 168 feet with eight spires of granite and concrete. Two fairs would be held in the unfinished interior to raise funds for its completion. The interior was finished on July 18, 1936. The Most Reverend Joseph E. McCarthy, DD, dedicated Saints Peter and Paul Church on October 23, 1938. An all-male choir, recently formed, provided music for the occasion. The total construction price was estimated at $625,000. Five bells, cast for the previous church in 1884 by the McShane foundry of Baltimore, Maryland, were retained for the new towers. In 1948, the magnificent stained glass windows of the nave were installed to the designs of Boston’s Terence O’Duggan, at a cost of $40,000. The building measures 330 feet long, 135 feet wide, and the ceiling rises 64 feet. The pews seat 1,800 persons.

There was considerable posturing to making Saints Peter and Paul the cathedral of the diocese, supplanting Portland’s Cathedral of the Immaculate Conception, founded in 1856 with its church built between 1866 and 1869 to the designs of Patrick C. Keely. Postcards of the Lewiston church were printed and sold, designating it a “cathedral.” However, the move of the seat of the bishop from Portland to Lewiston never occurred.

The building was listed on the National Register of Historic Places on July 14 (Bastille Day), 1983. The second-largest Catholic church in New England, Saints Peter and Paul is exceeded only by Saint Joseph Cathedral of Hartford, Connecticut. In the past two decades, the building has been restored, a heroic multi-million dollar project. The first part of the project, the exterior, took nine years to complete. The interior restoration of the upper church was completed in 2002.

The church’s music history is remarkable. In 1872, a reed organ was acquired, and a Mrs. Martel became organist. Mr. Alcibiad Beique succeeded her. Considered an accomplished organist as he had studied in Belgium, Beique would play the opening program/Mass on the church’s first pipe organ, described below. Beique would leave Lewiston to become organist for the church of Notre Dame in Montréal, Canada. Mr. F. Desanniers next served the parish, though he died about a year after beginning service, having consumed poison thinking it was medicine. Henry F. Roy then served Saints Peter and Paul, remaining until 1925. George C. Giboin then served from 1925 until his death in 1945. From 1945 until 1966, Bernard Piché was organist, while Roland Pineau directed the choirs. Piché was of considerable repute, and was managed as a recitalist by the Colbert-Laberge management group. Pineau continued as organist and choir director until 1973. Luciene Bédard also served as organist, beginning in 1942 and continuing for 54 years. Ida Rocheleau provided music from 1973 until 1982. Kathy Brooks was named music director in 1990. Scott Vaillancourt became music director in 2003 and continues today.

In addition to choral groups for children and adults, the parish sponsored a boys’ band (Fanfare Ste. Cécile) from 1898 until 1947. An extensive boys’ choir for grades 5 through 8 (Les Petits Chanteurs de Lewiston) was established in 1945 and performed operettas and other works in Lewiston and throughout New England until it was disbanded in 1964.

 

The pipe organs

The first pipe organ for the parish was 1880 Hook & Hastings Opus 1011, a two-manual, 24-rank instrument located in the 1873 church. The case of ash measured 25 feet high, 13 feet wide, nine feet deep. The organ cost $3,500 and was dedicated on Thanksgiving Day, November 25.

The organ was removed from the building prior to demolition and reinstalled in the new lower church in 1906. It was rebuilt and enlarged by Casavant Frères of Saint-Hyacinthe, Québec, Canada, in 1916, as their Opus 665, retaining the Hook & Hastings case and much of the pipework.

In 2004, Casavant Opus 665 was sold to the Church of the Resurrection (Episcopal), New York City, where it was moved and rebuilt by the Organ Clearing House. A series of dedicatory recitals were held for this organ in its new home in 2011.

The upper church Casavant organs together make up the largest church organ in Maine. There are 4,695 pipes in five divisions in the rear gallery, 737 in three divisions in the sanctuary. A four-manual, drawknob console controls the entire organ from the rear gallery; a two-manual console in the sanctuary, which does not function at this time, controls the sanctuary divisions. The organ was designed by Charles-Marie Courboin of Saint Patrick Cathedral, New York City. The contract specification was dated April 4, 1937. Manual compass is 61 notes (C–C); pedal compass (concave, radiating pedalboard) is 32 notes (C–G). The instrument cost $28,000 for the gallery organ, $10,000 for the sanctuary organ. A fifteen-horsepower blower was provided for the gallery organ, and a one-horsepower blower for the sanctuary organ.

Courboin, who travelled to Saint-Hyacinthe to inspect the organ in the factory, played the opening recital on the completed organ, October 4, 1938. An estimated 2,000 persons filled the nave of the church, the first public event to occur in the upper church. Casavant crafted the extensive woodworking lining the church nave, including an ornate screen in the sanctuary and the extensive wood supporting the organ and choir gallery, the transept galleries, and the narthex. The project utilizing Maine native red cedar and oak took a year and a half to complete.

Over the years, various renowned organists have concertized on the upper church organs. For instance, the Lewiston-Auburn Chapter of the American Guild of Organists sponsored Marcel Dupré in recital on Monday evening, October 4, 1948, along with three selections presented by the Saint Paul Choral Society. (Admission was $1.20, tax included, students $0.75.) The program for the organ’s tenth anniversary included works by Johann Sebastian Bach, George Frederick Handel, Eric DeLamarter, César Franck, Mr. Dupré, as well as an improvisation on submitted themes—Yankee Doodle and Turkeys in the Tree Top.

The fiftieth anniversary of the Casavant organs was celebrated with a concert on October 4, 1988, given by Brian Franck, organist, with l’Orpheon, conducted by Alexis Cote and accompanied by Luciene Bédard. Alan Laufman of the Organ Historical Society presented Historic Organ Citation #100 for the upper church organs. The upper church organs were heard in recitals during the national convention of the Organ Historical Society on August 19, 1992.

The gallery Casavant has experienced only three tonal alterations since installation. During Mr. Pinché’s tenure, the Grand Orgue 16 Bombarde was replaced by an 8 Bourdon. The Solo 16Tuba Magna was replaced by a 4 Orchestral Flute. And the Récit 8 Trompette was replaced by an 8 open flute. The 8Trompette rank was used for many years in the Casavant in the lower church. It is now in storage, awaiting restoration and reinstallation, or perhaps replacement with a copy, if necessary.

Saints Peter and Paul experienced its largest membership in the 1950s, with more than 15,000 souls on the records. Twenty years later, membership was less than half that number. In 1986, the Dominicans turned administration of the parish back to the diocese. In June of 1996, Saints Peter and Paul was “twinned” with nearby Saint Patrick Catholic Church.

On October 4, 2004, the Vatican raised Saints Peter and Paul Church to the dignity of a minor basilica. The basilica was inaugurated on May 22, 2005, by the Most Reverend Richard Malone, Bishop of Portland. In 2008, the basilica became part of the newly-formed Prince of Peace Parish, which in due time has included all the Catholic parishes of Lewiston. The parish today includes the basilica, Holy Cross, Holy Family, as well as cluster parishes: Holy Trinity, Lisbon Falls, Our Lady of the Rosary, Sabattus, and Saint Francis Mission, Greene (in the summer only). Holy Cross Church has a Casavant organ of two manuals, 25 ranks, installed in 1967.

Saint Mary Church would close in 2000 and become the home of the Franco-American Heritage Center. The Gothic edifice of stone was completed in 1927 to the designs of the same architect as Saints Peter and Paul. It is now used as a performing arts and cultural center, preserving much of the feel of the old church, including its stained glass windows. A photograph at the center’s website reveals that at least the twin cases of the church’s Frazee organ are still present. The organ itself is in storage at the center, awaiting funding for reinstallation.

Saint Joseph Catholic Church was closed October 13, 2009, and sits empty. It is listed on the National Register of Historic Places. Now owned by Central Maine Healthcare, the redbrick Gothic building has been threatened with demolition, though these plans are on hold as of this writing. The building once housed a two-manual Henry Erben organ from 1870, long since replaced by an electronic substitute.

Saint Patrick Catholic Church, facing Kennedy Park along Bates Street at Walnut Street, was founded in 1886. The parish, under the leadership of Monsignor Thomas Wallace, built a grand Gothic church, completed in 1890. Monsignor Wallace was buried in the church crypt. On October 27, 2009, Saint Patrick closed its doors. Its 1893 two-manual Hook & Hastings organ, Opus 1580 (electrified about 1960 by Rostron Kershaw, with minor tonal changes), was removed for relocation to Holy Family Catholic Church of Lewiston, a project partially completed by the Faucher Organ Company of Biddeford, Maine. Completion awaits sufficient funding. This is the first pipe organ for Holy Family Church.

Despite losing its claim as an industrial center in the state, Lewiston today remains the second largest city in Maine, behind Portland. Auburn is located across the Androscoggin River from Lewiston, and the two communities are often considered a single entity. The Lewiston community has experienced a renaissance in recent years.

The seventy-fifth anniversary of the Casavant organs in the upper church was celebrated throughout 2013. The parish sponsors a summer recital series, and that year’s performers included: Karel Paukert; Chris Ganza with Karen Pierce (vocalist); Albert Melton; Randall Mullin; Jacques Boucher with Anne Robert (violinist); Ray Cornils; Julie Huang; Harold Stover; Sean Fleming; and the author. The final program of this series occurred on September 27, featuring Kevin Birch, organist, the Androscoggin Chorale, John Corrie, conductor, and the Men’s Choir of the Basilica, Scott Vaillancourt, director. The program included: Prelude and Fugue in E-flat, BWV 552i, Johann Sebastian Bach; Andante Sostenuto, Symphonie IV, Charles-Marie Widor; Cloches, Marcel Fournier; Carillon de Westminster, Louis Vierne; Sonata I, Alexandre Guilmant, and the Mass for Two Choirs and Two Organs, Widor. Some restorative repairs have been made to the Casavant organs by the Faucher Organ Company of Biddeford, Maine. Ongoing efforts are made to raise funds to complete the project and bring this world-class organ back to its original glory.

Andover Organ Company marks seventy years

Anniversaries invite us to reflect upon our past and contemplate how far we have come. As 2018 marks Andover Organ Company’s seventieth anniversary, this article will highlight its long and rich history, from its humble beginnings to its recent achievements.

Andover was founded in 1948 as a result of an Organ Institute organized by Arthur Howes, head of the organ department at the Peabody Conservatory, and held each summer on the campus of Phillips Academy in Andover, Massachusetts. Howes had traveled extensively in Europe and observed the developing Organ Reform Movement there. Originating in Germany in the 1930s from Albert Schweitzer’s writings, the movement sparked an interest in early music and performance practices, as well as the building of new organs that could authentically render early music, especially that of Bach. Howes started the Organ Institute to help spread the Organ Reform Movement in America. The faculty included such notable organists as Carl Weinrich (Princeton University), Ernest White (St. Mary the Virgin, New York City), and E. Power Biggs.

Tom Byers, a former Henry Pilcher’s Sons Organ Company employee who lived in nearby Lawrence, Massachusetts, attended the annual institute with his wife. He was inspired to start an organ company that would follow the institute’s philosophy. He chose the name “Andover” for its prestigious association with the Organ Institute and because of the advantages, in the pre-internet days of telephone directories, of appearing near the top of the alphabetical company listings. 

Byers chose the opening line of Psalm 98, “Cantate Domino Canticum Novum” (Sing to the Lord a New Song), as the company motto, which still appears on Andover’s letterhead. This underscored his philosophy of creating a new style of organ, one that looked and sounded differently from what most American organ companies were producing.

Despite its name, the company has never been located in Andover! It started out in the home of Tom Byers in Lawrence, just north of Andover, and later moved to a two-story wooden building in nearby Methuen. In 1979 the company purchased a three-story brick building in a former mill complex at 560 Broadway in Lawrence, where it has been ever since.

 

Leadership and people

Rather than having a single leader dictate the company’s course, Andover’s many talented employees have each contributed to the company’s development. The company has always been owned and run by its principal employees who, serving as its shareholders and board of directors, make decisions collegially.

Charles Fisk joined the company in 1955 as Tom Byers’s junior partner. Robert J. Reich, a Yale-trained electrical engineer, was hired in 1956, and Leo Constantineau, a woodworking teacher and professional draftsman, in 1957. In 1958, Byers left the company, and Fisk became the owner. Walter Hawkes, who had worked for Holtkamp, was hired as shop foreman. Later that year, Andover signed a new organ contract with Redeemer Lutheran Church in Lawrence, Massachusetts. The contract did not specify the type of action. But the result, premiered on Palm Sunday 1959, was the first new mechanical-action organ built by an American firm in the postwar era. That instrument, Opus 28, is still in use.

The following year, Opus 35, a 33-stop tracker designed by Leo Constantineau and voiced by Charles Fisk, was built for Mount Calvary Episcopal Church in Baltimore, where Arthur Howes was organist. Fisk left Andover in 1961 to start his own company,
C. B. Fisk, in Gloucester, Massachusetts. Andover was reincorporated with Robert J. Reich and Leo Constantineau as the new owners. Reich, who became the Tonal Director, revised Andover’s pipe scales to provide more foundation tone. Constantineau’s case designs gave the company’s new instruments a distinctive visual flair. 

Andover has been blessed with several dedicated individuals who each worked over fifty years at the company. Reich, who joined Andover in 1956, served as President and Tonal Director 1961–1997; he then worked part-time until retiring in 2009. Donald Olson joined the company in 1962 and became Andover’s general manager and visual designer in 1968. His elegant case designs were the hallmark of Andover’s new instruments for nearly four decades. He succeeded Robert Reich as President in 1997, stepped down in 2012 and then worked part-time until fully retiring in 2015. Robert C. Newton, who started at Andover in 1963 and headed the Old Organ Department for many years, retired in 2016.

Andover’s current President, Benjamin Mague, joined Andover in 1975. He holds a Bachelor of Arts degree in music from Colby College and a Master of Music degree in organ from the University of Wisconsin. He served as Andover’s mechanical designer and later as shop foreman before becoming President in 2012. 

John Morlock, Andover’s Tonal Director since 1999, joined the company in 1976, working principally in the Old Organ Department. Don Glover, Andover’s in-house reed voicer, came to Andover in 2004 from the Reuter Organ Company.

Michael Eaton, Andover’s visual designer, joined the company in 1991. He also heads a maintenance team and serves as Treasurer and Clerk for Andover’s board of directors.

Andover’s present team of dedicated and talented people collectively possess over 350 years of organbuilding experience. Other current employees are Ryan Bartosiewicz, Matthew Bellocchio, Eric Dolch, Anne Doré, Andrew Hagberg, Lisa Lucius, Kevin Mathieu, Fay Morlock, Jonathan Ross, Craig Seaman, and David Zarges. Appropriately, more than half of Andover’s employees are church musicians or organists.

Andover has been the parent for many other New England tracker organ companies, having employed over its seventy years many talented individuals who later founded their own companies. These include Philip Beaudry, Timothy Fink, Charles Fisk, Timothy Hawkes, Richard Hedgebeth, Fritz Noack, Bradley Rule, J. C. Taylor, and David Wallace.  

 

Tonal style

Tonally, the early Andover organs were inspired by the Organ Reform Movement. At the time of Andover’s founding, few American companies were repairing old tracker organs; most just electrified or replaced them. Andover was the first to deliberately retain and renovate nineteenth-century trackers. But, adhering to the Organ Reform philosophy, Byers and his early successors often “improved” those organs tonally. It was not unusual for them to evict the string stops and replace them with mixtures and mutations. Andover’s new instruments came to be characterized by strong Principal choruses with bright mixtures, colorful neo-Baroque style flutes and mutations, and reeds that emphasized chorus over color. 

In the 1980s, as Andover began more frequently to work on significant nineteenth-century American organs, a gradual transition occurred. This was solidified in 1999 when John Morlock, who had started in Andover’s Old Organ Department, succeeded Robert Reich as Tonal Director.

Today, Andover’s tonal style may best be described as “American” and is grounded primarily in the best practices of the nineteenth-century New England builders, in particular the Boston firm of E. & G. G. Hook. Their organs, especially those from the firm’s “golden period” (1850s to 1870s), are admired for their remarkably successful blend of warmth and brilliance. Their pipe scales and voicing techniques worked extremely well in the dry acoustics of many American churches. 

When designing a new organ or reworking an existing instrument, we basically use the same scaling proportions between the various stops of the chorus that the Hooks used. We have found that doing so results in a principal chorus that is nicely balanced between fundamental weight and harmonic development.

Within this framework, adjustments are made to reflect or, in some cases, compensate for the acoustical properties found in each room. Each instrument needs to work and sound well in its “home” and be able to perform its tasks capably and effectively. Andover organs are designed to lead and support congregational hymn singing, as well as interpret a wide range of organ literature.

 

Maintenance

From the very beginning, organ maintenance was an important part of the company’s work. It created name recognition, established relationships with churches and organists, and provided a consistent revenue stream. Today, Andover maintains over 300 organs annually throughout the Northeast, Mid-Atlantic, and Southeast—from northern Maine to South Carolina, from western New York to the islands off eastern Massachusetts. These instruments range in size from small one-manual trackers in country churches to the world-famous Great Organ (IV/116) in the Methuen Memorial Music Hall; and range in age from a few years to a historic 1762 Snetzler organ. 

We service all types of organ mechanisms—from traditional tracker action to modern solid-state relays and combination actions. Each spring and fall, we schedule extended maintenance tours to visit multiple instruments in a geographical area. This enables our customers to share the travel expenses. 

Many customers treat us like old friends. Occasionally, a church secretary or organist will call us and merely say, “This is so-and-so at First Parish Church,” not realizing that we have over three dozen tuning customers with that name!

 

Andover Organ firsts

As the leader in the mid-twentieth century tracker organ revival in America, Andover pioneered many innovations that are now standard in the industry. Opus 25, a two-manual built in 1958 for the Rice Institute (now University) in Houston, was an electro-pneumatic instrument utilizing slider chests with pneumatic pallets, one of the first examples of this pallet type. This was decades before the adoption of the “Blackinton-style” pneumatic pallet.

In 1961, Andover carried out the first historically sympathetic restoration of a nineteenth-century American organ: the 1-manual, 1865 E. & G. G. Hook Opus 358 at the Congregational Church in Orwell, Vermont (Andover Opus R-1.)

Utilizing its expertise gained from restoring old tracker organs and building new ones, in 1963 Andover was the first company in the world to re-trackerize an old tracker organ that had been electrified. The instrument was the 1898 James Treat Opus 3 at St. George’s Primitive Methodist Church (now Bethesda Missionary Church) in Methuen, Massachusetts.

The slider and pallet windchests used in most nineteenth-century organs were generally trouble free for many years. However, when heating systems were introduced into churches in the early twentieth century, problems developed. The solid wood chest tops (tables), just below the sliders, were made from a thin, wide plank of air-dried lumber. With constant heating the wooden tables dried out and cracked, allowing air to leak from one pipe hole to the next, resulting in “runs.” 

Andover was the first American company to replace a cracked, solid-wood table with a marine-grade plywood one. The routed bleed channels between the table’s wind holes were then carefully replicated and the entire table graphited, like the original. This type of table replacement is now standard in the industry. The first organ to receive this treatment, in 1965, was the 1897 George W. Reed, at the Baptist Church in Winchendon, Massachusetts. Sadly, the organ burned with the building in 1985. 

One of Andover’s most significant recent projects was the 2016 restoration of the wind system and key action in the 1892 Woodberry & Harris Opus 100 at St. Mary–St. Catherine of Sienna Parish in Charlestown, Massachusetts. With three manuals, 36 stops, and 41 ranks, it is the largest and most significant nineteenth-century organ remaining in original unaltered condition in the greater Boston area. 

The instrument’s action is entirely mechanical and incredibly complex. The three-manual, reversed detached console sits in the center of the gallery, while the pipes and windchests are in cases at either side of a large stained-glass window. Four levels of trackers descend from the keys to squares beneath the floor, then under the console towards the rear window, then turn off at right angles towards the sides, then turn off again at right angles towards the rear, then to squares which send them up to the rollerboards below the chests. The organ’s four divisions have a total of 17 sets of wooden trackers, totaling nearly a mile in length! A Barker machine lightens the touch of the Great and the manuals coupled to it.

The two large reservoirs were stripped and releathered in place. All four layers of trackers were disassembled, labeled, and brought to the shop for replication. Because of the organ’s historic significance, all the new trackers were made of the same materials as the originals but using modern machinery. Andover customized a miniature CNC router to notch the cloth-wrapped tracker ends and built a spinning machine to whip the threaded wire ends with red linen thread, just like the originals. The Barker machine was carefully releathered. “Now she runs like a Bentley,” said one of the instrument’s many admirers.

 

Rebuilding for reliability

A conservative restoration is the logical decision for an exemplary work by an important builder or a small organ in a rural church with modest musical requirements. But sometimes it is necessary to strike a balance between preserving the original fabric and updating it to suit modern needs. An organ that has already endured several unsympathetic rebuilds, or an aging instrument with unreliable mechanisms and limited tonal resources, in an active church or institution with an ambitious music program might be better served by a sympathetic rebuilding. This was the case with two of Andover’s most significant rebuilds.

The 1876 E. & G. G. Hook & Hastings Opus 828 at St. Joseph Cathedral in Buffalo, New York, was built as a showpiece for the 1876 “Centennial Exposition” in Philadelphia and purchased afterwards by the cathedral. Major changes were made to the organ by Tellers-Kent Organ Company in 1925 and by Schlicker Organ Company in 1976. By 1996, the organ was virtually unplayable during the winter months and a decision of whether to replace it or rebuild it was imminent. In 1998, the cathedral decided that “the organ need not be replaced, but rather completely rehabilitated.” At the same time, the organ’s tonal palette needed expanding to better serve the musical needs of the cathedral and to enable it for use in concerts and recitals.

A team from Andover dismantled the organ in July 1999, loaded it into two moving vans, and transported it back to Lawrence, where eighteen employees labored for more than a year to clean, repair, and expand the instrument. In undertaking this immense job, Andover sought to retain and restore as much of the original as possible. The entire organ was cleaned, and the black walnut case stripped of coats of dark varnish and restored to its original finish. The façade pipes were stripped and repainted in their original designs with colors that harmonized with the cathedral’s interior.

All the original chests and pipework were rebuilt and repaired. The manuals were expanded to 61 notes and the pedals to 32. The two original reservoirs were releathered and two new ones constructed. The Choir is now unenclosed, as it originally was, the Swell box is back to its original size, and the Solo is restored to its original position.

Many of the missing original pipes were replaced with pipes salvaged from the Hook 1877 Cincinnati Music Hall organ, Opus 869. Other compatible Hook organs were visited to develop pipe scales appropriate for the additions to the cathedral organ, which were voiced in the Hook style. The organ is now far closer to its original sound than it has been since the 1923 electrification and rebuilding.

A new floating Celestial Division on a slider windchest was added. This division was based on contemporary E. & G. G. Hook solo divisions, as typified by the organs in the Cincinnati Music Hall and Mechanics Hall, Worcester. There is an 8 Philomela copied from the 1863 Hook at Church of the Immaculate Conception in Boston, an original Hook 4 Hohlpfeife, a 2 Harmonic Piccolo, a Cor Anglais, and a few more modern stops stops such as a French Horn, Dolcan Gamba with Gamba Céleste, Spitzflöte and Spitzflöte Céleste. 

Thomas Murray played the rededicatory recital on June 11, 2001. The St. Joseph Cathedral organ will be featured in a recital by Nathan Laube during the American Guild of Organists Northeast Regional Convention, July 1–4, 2019.

In contrast to the Buffalo cathedral organ, the 1902 Hook & Hastings Opus 1833 at St. John’s Seminary in Brighton, Massachusetts, was a modest two-manual, 18-rank instrument. After nearly a century of use and constant winter heating, the windchests and actions developed serious problems. The original console was replaced in 1946. When the replacement console failed in 2004, a one-manual tracker was put in its place to serve as a temporary instrument until the chapel organ could be rebuilt. 

Our lengthy experience with Hook & Hastings organs taught us that their early electro-pneumatic actions were cumbersome, slow, and difficult to repair. Therefore, in our 2014–2015 rebuilding of the organ, we reused the pipes, windchests, and most of the original parts as the basis of an expanded instrument with a new electric action.

We built a new, solid white oak console in the style of the Hook & Hastings original, with a lyre music rack and elliptically curved stop terraces. To meet the demands of a twenty-first century music program, this reproduction console has state-of-the-art components, including a record/playback module. The façade pipes were stripped and repainted with a new decorative treatment that harmonizes with the Italian Renaissance-style case and chapel. As a crowning flourish, the cross surmounting the case was painted in faux lapis lazuli.

Most of the organ was crammed within the small case, with Swell above Great and the wooden Pedal 16 Open Diapason pipes at each side. Behind the Swell, in an unfinished gallery, were the organ’s large reservoir and Pedal 16 Bourdon. We moved the Pedal Open Diapason pipes to the rear gallery and added a Pedal 32-16-8 Trombone and 8-4 Principal there. Judicious additions to the Swell expanded its resources. There was sufficient space inside the case behind the Great chest to add a seven-stop unenclosed Choir division.

The end result of these tonal changes and additions is an instrument of 40 stops, 34 ranks, and 1,994 pipes that is more versatile and appropriate for its expanded role. It still sounds very much like a Hook & Hastings organ, but one from an earlier and better period of the firm’s output.

 

Façade firsts

The company’s work with historic organs gradually led to pipe façade restorations as well. In 1967, Andover was the first American company to make restorative paint repairs to a painted and stenciled pipe façade, at the First Congregational Church in Georgetown, Massachusetts (1874 Joel Butler). Thirteen years later, in 1979, during its rebuilding of the 1884 Geo. S. Hutchings Opus 135 at the Vermont College of Fine Arts in Montpelier, Vermont, Andover carefully stripped a coating of green paint from all the façade pipes, documented the original designs and colors underneath, and repainted the pipes in their original colors and stenciling—another first.

Andover’s Opus 102 (1992) at Trinity United Church of Christ in York, Pennsylvania, was the first new American organ in the modern era to feature painted façade pipes with nineteenth-century style colored bandings. The upper façade flats of this organ contained another first: “frosted tin” pipes, which feature the natural, unplaned finish of the cast tin sheets. This gives them the light color of tin, but with a dull, non-reflective finish.

In recent years, Andover has worked with historic painted decoration conservator Marylou Davis to create new painted-pipe decorations in historically inspired styles. The most notable example of this collaboration is the 82-rank Andover Opus 114 (2007) at Christ Lutheran Church in Baltimore. This was the first twenty-first century American organ façade to combine polychromed and monochrome texture-stenciled pipes, frosted tin pipes, and numerous hand-carved pipe shades, grilles, finials, and skirtings in the casework. 

Opus 114 is also Andover’s first dual-action, double organ. The 13-rank, electric-action gallery organ can be played from its own console or from the front organ’s three-manual mechanical-action console. Likewise, the entire front organ can be played from the two-manual gallery console through couplers and general pistons. The organ’s four matching cases (two in chancel, two in gallery) perfectly suit the church’s Gothic architecture and fool many people into thinking that they were reused from a 19th-century organ. 

Andover has never been afraid to fit an organ around a prominent window. This reflects our design philosophy that an organ should look as if it has always been part of its environment. And in most churches, the window was there long before the organ. Fighting the window can sometimes be a losing battle. Opus 115 (2007) at Church of the Nativity in Raleigh, North Carolina, and Opus 118 (2014) at First Parish Church in Wayland, Massachusetts, illustrate Andover’s creative approach in dealing with windows.

In Raleigh, the modern clear glass window was front and center, at the top of the space where the organ would go. We designed the organ case to frame the window’s central orb and cross. The polished tin façade pipes match the brightness from the window. The organ also serves as a reredos for the altar, which stands in front of it. Looking from top to bottom, one sees the window, the organ, and the altar—light, music, action. The church was very pleased with the result, as were we.

In the 1820 Federal Period meetinghouse in Wayland, there was an elegant Palladian window in the center of the back wall of the rear gallery. Because of the semi-elliptical curve of the gallery’s rear wall, the only apparent organ placement with such a floor plan was in the center. Thus, all the previous organs had blocked the window. Andover’s design put the detached console in the center, by the railing, and divided the organ into two cases that frame, rather than cover, the Palladian window. The choir members sit in the space between the console and cases and benefit from the natural backlighting provided by the window. Again, everyone was pleased with the results.

Seventy years after its humble beginnings, Andover has much to celebrate: 118 new organs and 533 rebuilds/restorations. Andover’s wide-ranging work in building, rebuilding, restoring, and maintaining pipe organs is well-recognized, and best summarized by its mission statement: “Preserving the Past; Enhancing the Present; Inspiring the Future.”

Awareness in the wild

Cecil the Lion was a famous and favorite icon of Zimbabwe’s safari tourist industry. He was beloved by thousands who visited his home in Hwange National Park, and his photos were published around the world. He was thirteen years old and was central to a long-standing conservation study by biologists at Oxford University who had fitted him with a tracking device when he was six years old. He was huge and majestic, and he was easily recognizable because of big black streaks in his mane.

In the last days of July 2015, Cecil became an instant posthumous global celebrity when he was killed by Walter Palmer, a dentist and skilled trophy hunter from Minnesota. International news services and social media have been crackling with the story, Palmer is in hiding, the guide and landowner who had been paid to help with the hunt have appeared in court and been released on bail, and Cecil’s remains have been returned to the Zimbabwean government.

Palmer had paid for a license for such a hunt, but allegedly illegally lured Cecil outside the park, and as of this writing on August 1, the United States and Zimbabwean governments are discussing Palmer’s extradition. Thanks to social media, donations are pouring into wildlife conservation funds in six-figure clumps. Jane Goodall, who famously has spent more than fifty-five years studying chimpanzees at Gombe National Park in Tanzania, released a statement lamenting Cecil’s death that concludes, “Only one good thing comes out of this—thousands of people have read the story and have also been shocked. Their eyes opened to the dark side of human nature. Surely they will now be more prepared to fight for the protection of wild animals and the wild places where they live. Therein lies the hope.”

The timing of Cecil’s death was exquisite. Just a few days earlier, on July 25, while traveling in Kenya, President Obama released a statement that would effectively ban commercial trade in African elephant ivory in the United States. That announcement follows Obama’s executive order of July of 2013, in which he declared that the United States should “lead by example,” encouraging other nations to step up their active participation in the preservation of that majestic species. The United States Fish and Wildlife Service (USFWS) followed on February 25, 2014, by proposing a new rule affecting the trade and movement of ivory. For more background, I recommend you refer to the excellent article written by harpsichord specialist Anne Acker and published in the September 2014 issue of The Diapason. Ms. Acker did a great deal of excellent research and was generous with her time talking with me.

 

The specifics are presented in a chart. They include exemptions for any ivory more than one hundred years old (difficult to prove in many cases) and light exemptions for the domestic transportation of privately owned ivory. If you want to bring your grandmother’s harmonium home, there are no federal restrictions, unless your grandmother lived outside the United States.1 No importing of ivory is permitted, period—except sports-hunted trophies. There is no restriction on importing sports-hunted trophies. Hang that on your wall.

 

Citing CITES

On July 1, 1975, the Convention on International Trade in Endangered Species of Wild Flora and Fauna (CITES, pronounced sight–eze) was implemented, the culmination of nearly fifteen years of international negotiation. The text of the treaty had been finalized two years earlier by eighty nations. Today, more than 180 nations enforce the terms of CITES, which oversees the protection of more than 30,000 species of animals and plants. You can see a list of protected species at www.fws.gov/
endangered/species/us-species.html. They are categorized as “E” (endangered), “T” (threatened), “SAT” (threatened because they’re similar in appearance to an endangered species), etc.2

Loxodonta africana (the African elephant) is the source of the most highly prized ivory, and that species was added to Appendix I of CITES on January 18, 1990. USFWS regulations currently in effect allow trade in ivory that was legally removed from the wild before that date.

With Obama’s Kenyan announcement, the clock started ticking. The USFWS released the latest version of the new ban on trade and movement of ivory. The agency is receiving comments from the public until September 28, 2015, after which the regulation will be amended once more and put into force. The version now open to comment includes revisions of that published in Feburary 2014 (that you’ve already read). Again, it’s a neat summary, comparing the present proposal with that of 2014, and it’s easy to read. While commercial imports are entirely prohibited, sports-hunted trophies would now be limited to two per hunter per year, a big improvement over no limit at all, but if you maxed out the limit year after year, you’d need a mighty big house in which to hang them.

 

The Times Square Crush

Anyone who has navigated the sidewalks and pedestrian walkways in New York’s Times Square knows about the crush of humanity that throbs twenty-four hours a day. On June 19, 2015, the USFWS staged a different Times Square Crush. A huge industrial rock-crushing machine, the hulking behemoth that crushes boulders into gravel at highway-construction sites, was driven into the center of the square, and a ton of ivory artifacts that had been seized in an undercover operation was sent up into the machine on a conveyor belt and crushed to powder. Secretary of the Interior Sally Jewell presided over the event.

Two years earlier, the USFWS staged an ivory crush in Denver, Colorado, at which six tons of artifacts were destroyed. A statement published on the website of the USFWS reads, “Since that crush, several governments throughout Europe, Africa, the Middle East, and Asia, have also destroyed ivory, joining with us to highlight this worldwide crisis and emphasizing that only a worldwide solution will stop wildlife poaching.” You can read the full statement and view videos of the Times Square Crush at www.fws.gov/le/elephant-ivory-crush.html.

These events were controversial—cheered by conservationists who believe that eliminating the commercial value of ivory is the strongest tool for the elimination of illegal poaching, and decried by others who claim that such destruction will not bring back dead elephants, and that diminishing the value of the ivory will diminish the care of the animals in the wild and drive the ivory market underground, likely leading to higher prices for illegal ivory. Still others feel that destruction of beautiful artifacts may make an emotional or political point, but would never have any impact on illegal poaching in Africa.

 

Who uses elephant ivory?

Readers of The Diapason will naturally think of musical instruments. Piano, organ, harpsichord, and harmonium keyboards were most typically made of ivory. Ivory veneers on natural keys are prized because as a natural grained material, ivory absorbs moisture, so the perspiration from the performers’ fingers doesn’t build up into slick pools on the keys. Ivory is also the most durable natural substance used on keyboards and arguably one of the most beautiful. And many organ consoles have engraved ivory knob faces, knob heads, and coupler tablets. 

Many guitars, violins, and other stringed instruments have small ivory parts such as the bridges and nuts that bear the strings, where it is prized for its acoustical properties. Ivory is also used for decorative elements on many musical instruments, and some wind instruments, both western and non-western, are made entirely of ivory.

Artisans who fashion high-quality pool cues are the largest consumers of new ivory (except in China, where carving remains prevalent), which is used in the tip (where the cue meets the ball) and the ferrules that join sections of the cue. Master players feel that those ivory parts give the ideal strike of cue to ball. No pianos and only a very few pipe organs are built with new ivory on the keyboards.

Builders of custom firearms use large pieces of ivory for rifle stocks, pistol grips, and many forms of ornamentation. And there is an active community of carvers and sculptors who specialize in working with ivory.

 

What does it have to do with me?

The proposed ban on trade and movement of ivory would have a big effect on the manufacture, restoration, sales and purchases of musical instruments. The American Institute of Organbuilders (AIO) has engaged a lobbyist, and the Associated Pipe Organ Builders of America (APOBA) is participating in a larger lobbying effort spearheaded by the National Association of Music Merchants (NAMM).

There is a revision aimed at musical instruments. In the “Proposed Changes” PDF that you’ve just read, the section of the chart devoted to “Sales across state lines” includes an exemption for certain manufactured items that include a small (de minimis) amount of ivory. Here’s the section from that PDF that defines de minimis:3 

 

“What is the de minimis exemption? 

The proposed rule provides an exemption from prohibitions on selling or offering for sale in interstate and foreign commerce certain manufactured items that contain a small (de minimis) amount of ivory that meet the following conditions: 

 

A. If the item is located in the United States, the ivory must have been imported prior to January 18, 1990, or imported under a CITES pre-Convention certificate with no limitation on its commercial use. 

B. If the item is located outside of the United States, the ivory must have been removed from the wild prior to February 26, 1976. 

C. The ivory is a fixed component or components of a larger manufactured item and not the primary source of the value of the item. 

D. The ivory is not raw. 

E. The manufactured item is not made wholly or primarily of ivory. 

F. The total weight of the ivory component or components is less than 200 grams.

G. The item must have been manufactured before the effective date of the final rule.”

 

Item “F” in that list is directed at musical instruments. The USFWS acknowledges that 200 grams is the typical weight of the ivory veneers on a piano keyboard, and as that would allow the usual amounts of ivory found in stringed and wind instruments, it seems a fair number.

But let’s talk about the organ. A standard 88-note piano keyboard has 52 natural keys—the average weight of ivory for each natural key is about 3.8 grams. A standard 61-note organ keyboard has 36 naturals, which at 3.8 grams each would total about 137 grams for each keyboard. And here’s where the math fails for the pipe organ:

 

Most organs have at least two keyboards—ivories on a two-manual organ would weigh a total of 272 grams, well over the limit.

Many finer organ keyboards have special thick-cut ivory, at least twice as thick as that found on a piano.

Many organ consoles have ivory knobs and tablets. The elegant 1¼ ivory faces found on older E.M. Skinner organs weigh about 10 grams each.

Using those facts, a four-manual console with a hundred knobs would contain nearly 1400 grams of ivory, which is almost 3¼ pounds!

 

That may seem like a lot of ivory. But let’s go back to the sports-hunting exception. According to the website www.fieldtripearth.org, the average weight of an African elephant’s tusk is around 135 pounds. A trophy hunter could legally bring home four tusks a year—that’s 540 pounds hanging over someone’s fireplace.

Under the proposed restrictions, it would be illegal to buy, sell, or transport organ consoles, it would be illegal to file or sand existing ivory during restoration of a console, and it would be illegal to use replacement ivories salvaged from other keyboards to replace those chipped or cracked. “Working” ivory, altering existing and otherwise legal artifacts, would be completely prohibited. If your church hired an organbuilder from another state to restore the Skinner organ, they would be prohibited from transporting the console back to their workshop. They’d have to leave the keyboards and stop jambs behind.

 

What’s the solution?

Earlier, I mentioned that the clock is ticking while the USFWS receives comments from the public. The USFWS website has clear instructions about how to submit your opinion:

While preparing this essay, I’ve spoken with the presidents of the American Institute of Organbuilders and the Associated Pipe Organ Builders of America, the attorney engaged by the National Association of Music Merchants, a supplier of ivory, and an environmental journalist, and I’ve heard conflicting opinions. 

Some conservationists hold an extreme position that all trade in ivory should be banned without any exceptions. Others feel that some kind of middle ground is reasonable, and the USFWS seems to be receptive to such input. The 200-gram exception shows that. Still others feel that the proposed restrictions are counter-productive and could actually result in harming the stability of the elephant population while encouraging illegal trade. 

 

What’s the answer?

I will go to www.regulations.gov, enter FWS-HQ-IA-2013-0091 into the search field, and submit these suggestions:

 

On January 18, 1990, the African elephant was added to Appendix I of CITES. The current regulation allows trade of de minimis amounts of ivory that was legally removed from the wild before that date.

The spirit of the 200-gram exception is to exempt ivory as found in musical instruments.

Pipe organs require more natural keys than pianos. Because the use of ivory as found in organ consoles is identical to that in pianos, any amount of ivory found in pipe organ consoles, legally removed from the wild before January 18, 1990, should be exempted.

Much of the impetus behind the bans and the staged crush events is the possibility of new ivory being disguised as antique and slipped into the market. (Anyone who has spilled coffee or tea on a keyboard knows it can be done!) But I doubt such disguise is possible with older organ keyboards.

I wonder if the USFWS can suggest ways that legitimate craftsmen could help watch for disguised illegal material.

There’s an exception in the proposed rules for museums, allowing the display of ivory artifacts in their galleries, or as part of traveling exhibitions.

Religious, educational, and other not-for-profit institutions could be granted similar exemptions for the preservation of their existing musical instruments.

If the regulation allows even one self-indulgent trophy hunter to bring home a carcass or part of one, it shouldn’t restrict the sale of an historic organ console.

 

My several conversations have made it clear that whatever revisions are made, no new use of ivory and no importation will be permitted. That’s off the table. This will devastate some businesses, and severely limit others. It’s likely that no new “working” of ivory that’s less than a hundred years old will be permitted, including material dating from before 1990. While it’s possible that a subsequent presidential administration would weaken or reverse these rules, there’s less than a month left as you read this to comment before they take effect.

While I believe that ivory is the premium material for use on keyboards, I know very well that there are other suitable, even desirable materials. Cow bone has natural grain and therefore similar absorbing properties, though quality varies, and I know of bone keyboards that haven’t held up well. Many tropical hardwoods (some of them endangered species) work well, though they don’t wear as well as either ivory or bone. Fruitwoods are great, and you can throw the scraps in your barbeque grill to flavor the meat. And pretty much every modern concert piano has plastic keys. Scores of great musicians play on plastic before huge audiences every day. It would be hard to maintain that it’s impossible to build pipe organs without new working of ivory.

The 1990 rule works for me. If musical instruments built since then included ivory harvested earlier, they should be exempted. But from now on, no new cutting of any ivory.

The 2014 Ivory Trade and Movement Restrictions

Unless you read the White House Blog daily, you no doubt missed a quiet but monumental announcement. On February 11, 2014, the White House issued an executive order essentially banning international trade in items containing ivory, as well as tightly controlling movement of personally owned items containing ivory. Two weeks later, on February 25, 2014, Dan Ashe, director of the U.S. Fish & Wildlife Service, released Director’s Order 210 giving the draconian details of implementation. The executive order and director’s order were immediately enforced, including being applied to CITES (Convention on International Trade in Endangered Species) import and export applications filed months earlier. Restrictions on intrastate and interstate sales and movement were announced on May 15, 2014, along with other revisions discussed below. The Executive Branch and the U.S. Fish & Wildlife Service have ignored federal requirements for publication of proposed regulations and public comment before enforcement.

You have perhaps learned, e.g., of violin bows belonging to members of touring European orchestras being confiscated upon entry to the United States, or of the refusal to give a CITES permit for the import of a significant harpsichord by a United States collector/performer. The new regulations are being enforced through immovable, irrational requirements that ignore personal property rights of owners of legally acquired items containing ivory. Further complicating the situation are diverse actions by individual states, in particular, New Jersey, New York, and California. These actions have far-reaching effects among musicians, collectors, musical instrument dealers and repair people, and everyday citizens.

According to President Obama, the United States needs to “lead by example” with tough restrictions on all trade and movement of ivory. It is unclear why any country—especially China, the primary and nearly sole market for illegal new ivory—would be influenced by restrictions in the United States. The U.S. Fish & Wildlife Service has acted, in their words, “to close the loopholes” of transportation and markets for illegal new ivory in the United States, theoretically reducing pressure on elephant populations.

The illogic of thinking a legally acquired musical instrument, or ivory-inlaid 17th- or 18th-century furniture, or ivory Torah pointers, or knives or canes containing antique or pre-Convention (1976) ivory would be conduits for new ivory seems apparent to us, but the new regulations are rigidly defended by the U.S. Fish & Wildlife Service staff. Director Dan Ashe also states that they cannot tell new from old ivory thus justifying their methods (guilty until proven innocent, yet worse), a statement that has experts and repair people familiar with antique ivory shaking their heads in strong disagreement. In truth, I think he is speaking more to the lack of expertise among inspectors. In the United States, there are few instances of trade in illegal new ivory, though a few notable episodes have helped fuel this maelstrom, one involving faked African antiques in Philadelphia, and another of faked Asian antique figurines in New York City. Both were caught by appropriate profiling of the merchants and thorough investigations. The nets are being cast far wider now, and being visible targets, musical instruments have been particularly persecuted.

So, why the urgency and drama? The story is that the African elephant is in dire danger of losing 1/5 of their population over the next twenty or thirty years and then extinction. Beware the numbers appearing in seemingly reputable publications, as incorrect, unsubstantiated figures are being propagated. In stark contrast, looking at CITES’ own recent reports,1 there are currently about 500,000 African elephants in Africa, down from a probable 600,000 in 1989.2 About 22,000 elephants have been killed in each of the last several years, an admittedly horrific number, but actually decreasing, not increasing as claimed. 

According to the CITES report referenced above, the poaching rate appears to have leveled off and further affirms that poaching is primarily due to “extreme poverty and lack of governance in the affected areas.” Local farmers and corrupt game wardens earn huge payments for leading poachers to their prey. In some countries elephants are already at risk, while in others they are over-populated, causing serious problems by destroying farmers’ crops and overgrazing their own protected preserves. In these countries, culling is necessary. Their governments want to sell their large ivory stores in a controlled fashion, to raise money for the local human and elephant populations. A regular source of legal ivory sales would dramatically bring down prices and deter the brutal and horrific practice of poaching.3

 

Prior and current rules 

(These are subject to change.)

Previously there were no domestic restrictions for sales or travel of items containing ivory and CITES permits could be acquired for import and export of legally acquired ivory by following instructions, paying a fee, and filling out paperwork, a somewhat onerous but do-able process. Exemptions were granted allowing import or export of items that could be demonstrated to be antique (over 100 years old), or pre-Convention (1989 for African elephant ivory). All of this changed in February. “Commercial” imports of ivory are forbidden. Period. No exceptions. Exports are limited, but the hoops to jump through have made permits virtually impossible to acquire. As of May 25, 2014, the details of the regulations were eased somewhat thanks to various musical instrument related organizations with lobbyists working tirelessly in Washington, D.C., but the limitations and requirements are still unreasonable and unclear and were expanded to severely restrict sales within states and across state lines.

Remember while reading this web page and the explanations of it below, that qualifying for the CITES documents is extremely difficult. Here is the summary, with remarks about qualifying for the exemptions below.

 

Commercial imports

Forbidden. If you buy an instrument out of the country, you will not be able to get it into the United States. Note that the term “commercial” is being applied to any transaction that could be conceived of as resulting in a financial gain. For example, if you want to import an instrument and donate it to your favorite institution, they consider that commercial, since you may be applying for a tax deduction for the donation. Instruments bought overseas before the ban was announced, but awaiting their import permits, had their permits abruptly rejected. 

 

Personal imports 

You may import an item containing ivory as part of a household move or inheritance, or as part of your own musical instrument or as part of a traveling exhibition as long as the item contains “worked elephant ivory that was ‘legally acquired’ and removed from the wild prior to February 26, 1976 and has not been sold or otherwise been transferred for financial gain since February 25, 2014.” Thus you will not be able to bring in (or out) of the country any ivory-containing item that was purchased after February 25, 2014. (This is at least a significant improvement of the original specification of not being transferred for financial gain after 1976!) This freezes instrument ownership for touring musicians and amateurs as of the date of the Director’s Order. Additionally, the individual or group must qualify for a CITES musical instrument certificate and the musical instrument containing worked elephant ivory “must be accompanied by a valid CITES musical instrument certificate or equivalent CITES document.” The instructions do not specify what would qualify as an equivalent document. 

Commercial export 

While the rules state that pre-Convention and antique items containing worked ivory may be exported, in reality the new requirements to qualify for a CITES export certificate are extremely difficult-to-impossible to satisfy. Fortunately, in May they did eliminate two of the most ridiculous aspects of the February 25th Director’s Order, wherein 1) no domestically made items containing worked ivory could qualify, and 2) the exporter had to supply evidence that the item had entered through one of the “specified ports” for ivory import/export, despite the fact that these ports did not exist before 1982. If the ivory was repaired or modified after 1973, it will not qualify. If the item was originally imported after 1982, then it must demonstrably have been imported through one of the 13 ports of entry designated for antiques made of Endangered Species Act-listed species (Boston, Massachusetts; New York, New York; Baltimore, Maryland; Philadelphia, Pennsylvania; Miami, Florida; San Juan, Puerto Rico; New Orleans, Louisiana; Houston, Texas; Los Angeles, California; San Francisco, California; Anchorage, Alaska; Honolulu, Hawaii; and Chicago, Illinois).

To qualify under the antique exemption, the exporter must document the item’s age and identify the species used. Proof of age can be through scientific testing at an accredited laboratory or facility, a qualified appraisal, or provenance through other documentation, such as a detailed history of the item, family photos, ethnographic fieldwork, or other evidence that assigns the work to a known period of time. Fortunately, most musical instruments can be dated quite accurately. The species can be identified through DNA analysis (but this is unusable as the large quantities required would destroy that part of the musical instrument), or a qualified appraisal or other documentation that demonstrates the identification of the species through a detailed provenance. In practice, there have been difficulties with Fish & Wildlife permit examiners insisting on satisfying all of these dating and species methods and requiring a description of the “scientific method” used to make the species determination. Note that there are visual ways to identify the different types of ivory, except that Asian and African elephant cannot be visually distinguished. Again, the ivory must not have been “repaired or modified.” U.S. Fish & Wildlife agents reviewing applications are insisting on full details of restorations, not just whether the ivory was repaired. This despite that in reality, restorers do not need to, want to, or use (expensive, illegal) new ivory. There are synthetics and ample supplies of surplus antique ivory, e.g., in the form of old piano key tops. Regardless, as the rules are written, if the ivory was repaired, they can refuse the application even if you just filled a crack with dental epoxy. Whether having glued a piece back on would result in denial is unclear.

The burden of proof has been laid heavily on the exporter in an “all are guilty until proven innocent” fashion. Fish & Wildlife agents reviewing applications since February have been virtually impossible to satisfy. Some insist appraisers are trained in biology or wildlife forensics. The director has told them they don’t have to believe any documentation and to “set a high bar.” This writer, who has been importing and exporting antique pianos for over ten years, was informed that the common knowledge, as well as published information, that piano key tops were made from African elephant ivory, was now insufficient. This was despite pointing out that I was initially told by a Fish & Wildlife official years ago that African elephant ivory (Loxodonta africana) was the correct species to specify for ivory key tops and all my other previous applications were all accepted stating this species.

 

The Musical Instrument Certificate or “Passport”

After being besieged by concerned touring musicians, the U.S. Fish & Wildlife Service and CITES created a new permit certificate for people traveling regularly with their instruments, called the Musical Instrument Certificate or “Passport.” The application is available on the Fish & Wildlife website (www.fws.gov/international/pdf/permit-application-form-3-200-88.pdf).

They require a signed appraisal or other documentation to demonstrate the age of the ivory-containing item, which must pre-date 1976. You must also include a signed statement (though it does not say signed by whom) that the item has not been repaired or modified on or after December 28, 1973, with any part of any species covered by the Endangered Species Act. That should suffice for antiques (over 100 years old), but for export of younger items, it additionally says the applicant must also state whether the item was bought, sold, or “offered for sale by you or anyone else” since December 28, 1973, in which case “there may be a need for additional information and the Division of Management Authority will contact you directly.”

Confusingly on the form, this last category is apparently not applicable if your instrument includes African elephant ivory. What is worrisome is that the wording opens the door to interpretation by the examining agent to not allow the export at all if the subject item contains elephant ivory. Additionally worrisome is the inclusion of a note that African elephant ivory removed from the wild after February 4, 1977, is not considered to be pre-Convention (for the purposes of this application, since it most certainly is in the rest of the world). Given the recent difficulty in establishing the species of elephant to the satisfaction of the USFWS agents, it will likely be difficult to get approval for any personal musical instrument containing ivory to travel.

Note that you need a different CITES form for each endangered species in your instrument, including rosewood and tortoiseshell. Also note that you and your instrument will need to exit and enter the country ONLY through one of the 13 designated ports for ivory: www.fws.gov/le/designated-ports.html.

If your instrument contains a listed endangered plant species, you are further restricted to exit and enter through a designated port for listed plant species: www.aphis.usda.gov/import_export/plants/manuals/ports/downloads/cites.p….

Obviously this makes travel arrangements even more complicated and there are no plans to expand on the number of designated ports.

A fee of $75 is due with the application, which can take 45–60 days or more for approval, processing, and return. The certificate is good for three years, but you must bring the instrument back into the issuing country before it expires, at which point you can apply for a new certificate.

Domestic: intrastate and 

interstate trade and movement

Beginning on June 26, 2014, domestic sellers of items containing worked African elephant ivory must demonstrate that any item offered for sale—whether across state lines or within a state—was lawfully imported prior to the CITES Appendix-I listing of the African elephant (January 1990) or under a CITES pre-Convention certificate. Appendix-I covers species around the world most at risk as a result of international trade. Non-commercial movement is still allowed. There has been no clarification of how commercial may be defined beyond sale or what documentation is needed for such things as household moves. Some fear that traveling over state lines to perform at a paid concert could be considered a commercial transaction. Emphasis seems to be on sales, but given the vagueness of the rules both to the populace and the U.S. Fish & Wildlife Service agents, and recent aggressive enforcement, it is a concern. At least one piano transport truck has already been stopped and questioned with the result that the firm will no longer move pianos with ivory key tops. Another said they would just leave any questioned piano on the roadside and keep going. 

Unfortunately for musicians and others involved with legally obtained pre-Convention ivory, public support for the ban is being fanned with false numbers, hysteria, dramatic photos, and endorsements by celebrities who apparently can’t do the simple research required to discover the truth. For example, the performer Billy Joel publicly requested people save elephants by not having their pianos made with ivory keys, apparently unaware that no pianos have been made with ivory key tops in the United States since 1956 and in Europe since the 1980s. It appears that there is massive funding for public “awareness” and high-level political influence by some large conservation groups.

 

California, New Jersey, and New York State

Individual states have begun a hodgepodge of their own restrictions. In spring of 2012 California began to enforce a law that has been on their books since 1970 by raiding an auction house in northern California and seizing approximately $150,000 worth of ivory objects. This law has no exemption for antique and pre-Convention ivory and criminalizes possession with intent to sell, with stiff penalties. Introduced on May 8, 2014, both houses of New Jersey’s legislature quickly and quietly passed a draconian bill signed by Governor Christie on August 1, 2014. This law includes elephant, hippo, mammoth (which has been legally used to substitute for elephant ivory in recent years), narwhal, walrus, and whale ivory. It is unlawful to import, sell, purchase, offer for sale, barter, or possess with intent to sell any item containing ivory. 

There are no exceptions for antiques or pre-Convention ivory. It is legal to convey ivory to the legal beneficiary of an estate after death or in anticipation of death. The penalties are stiff, and ivory products will be seized and transferred to the New Jersey Department of Environmental Protection for “proper disposition.” The New York State legislature quickly followed with a ban on the sale of elephant and mammoth ivory and rhinoceros horn that Governor Cuomo supports. The New York Department of Environmental Conservation may issue permits for the sale of documented antiques over 100 years old and containing less than 20 percent ivory and musical instruments made prior to 1976 (this is bad luck for the New York owners of Bösendorfers and Hamburg Steinways made in the 1980s with ivory key tops). In all these cases, vagueness of wording is a serious problem. Technically, federal laws take precedence, but until court battles ensue, those with non-antique but pre-Convention ivory or insufficient “proof of provenance” will not be able to sell their items intact.

 

Current and potential effects

Many antique and pre-Convention cultural artifacts contain ivory, including Torah pointers, George Washington’s false teeth, medical demonstration figures, scrimshaw art, and of course, musical instruments. Key tops, guitar nuts, saddles and tuning pins, wind instrument rings, stringed instrument bows, organ stop knobs, and more have been made from ivory for its workability, beauty, availability, density, durability, and tactile and acoustic properties. Many musical instruments remain in active use for generations and commonly travel with their owners.

Already, the international import ban has prevented collectors from importing important pieces for study, performance, and recording in the United States. Because of the abrupt announcement and enforcement, quite a few people buying or selling internationally have found themselves unable to get instruments to their new homes. Reduced to the domestic market alone, musical instrument values will necessarily drop. If domestic trade is further restricted this summer, the value of ivory-containing objects will be reduced to virtually nothing, nor will anyone be able to receive a tax deduction for donations of instruments to institutions since that is considered “financial gain,” a serious potential loss of donations to colleges, universities, museums, and other public institutions.

The restriction of musical instrument certificates to instruments that have not transferred ownership for any financial gain after February 25, 2014, prevents internationally traveling musicians from upgrading, or ever again purchasing any instruments or bows containing ivory that can travel with them. Given the expense and paperwork to obtain the musical instrument passports, along with the aggressive and suspicious stance of the customs officials, it is highly likely there will be less touring of musicians in and out of the United States. Again, musical instruments containing ivory will be significantly devalued. Additionally, it will take a great deal of time, paperwork, and human power to administer and enforce all these new regulations. This will cost taxpayers dearly and consume considerable personal time for applicants, while not preventing the loss of one elephant to poaching.

 

Look-alike problem

It is very important to point out that customs agents are rarely skilled at identifying materials and may even presume, for example, that all instruments of a type are suspect. This has resulted in items containing “look-alike” materials and even with no ivory-like material being confiscated from their cases at border crossings with no explanations. It is highly advisable to have prepared and accompany your instrument with copies of an official appraisal or listing by the maker of the materials used in your musical instrument, whether it contains any suspect species or not. Also insist, as is your right, to be present when your instrument is inspected before shipping. Take photos of what is in the crate or case before shipping.

 

Late-summer developments

On July 14, 2014, two bills (H.R. 5052 in the House of Representatives, and S. 2587 in the Senate) were introduced; both would prohibit U.S. Fish & Wildlife from implementing any “new rule, order, or standard regarding the sale and trade in ivory that was not in place before February 25, 2014.” As of August 2, H.R. 5052 had 20 bi-partisan co-sponsors, an encouraging development. In addition, in early July, the House Appropriations Bill for the Department of the Interior included language that would prohibit U.S. Fish & Wildlife from spending any funds to enforce any rules, orders, or standard not in place before February 25, 2014. The appropriations bill has passed the Senate but faces a battle in the House of Representatives. The appropriations bill language is intended to put a moratorium on enforcement until a permanent method of undoing the disastrous actions of February 11 and 25, 2014, can be put in place. The appropriations bill includes other language against other more publicly controversial programs, but I am hopeful the ivory section will be kept as a trade-off against other concessions. The final hurdle is, of course, whether President Obama will sign or veto any of these bills.

 

What you can do to help

It is urgent that we eventually press for a permanent solution to protect cultural artifacts made before any species included in them was declared endangered. The current problems are regulations and enforcement rules, not laws, and can be changed with enough pressure. Lobbyists are working for groups such as the League of American Orchestras, National Association of Music Merchants, and some private individuals (e.g., through the important Podesta Group), and are kindly sharing information and guidance. Thanks to the efforts of many, we have the promising bills to be debated in Congress. Numbers count! It is critical for as many people as possible to write to their members of Congress, the President, the Secretary of the Interior, the Director of Fish & Wildlife Services, those on the Committee for Wildlife Trafficking (www.fws.gov/international/advisory-council-wildlife-trafficking/bios.ht…), Natural Resources, and the Congressional Committee on Fisheries, Wildlife, Oceans and Insular Affairs. Most useful is to try to get a personal or phone appointment with your senators and representatives and explain why these regulations are harmful and will not save any elephants. E-mails through their websites are also working for some. Ask them to support and co-sponsor H.R. 5052 and S. 2587. The important talking points are:

• We want to end the poaching of African elephants and illicit trade in new illegal ivory, but banning the domestic sale and trade of legal ivory in the United States and preventing import of antique and pre-Convention items containing ivory will not stop poaching, nor save one living elephant. 

• The July 2014 CITES meeting emphasized that the cause of poaching is extreme poverty, lack of governance, and corruption in the affected areas. Efforts need to help the affected communities and fund intelligence operations that locate poachers and dealers.

• The ban unnecessarily hurts owners of antiques and pre-Convention items containing ivory legally imported into this country by stripping their value, resulting in a taking of billions of dollars from law-abiding Americans. The domestic ban would devastate the current market in worked ivory items, causing legitimate business owners and everyday citizens tremendous economic harm. Note how the ban will hurt you personally. The analysis of the economic effect of this ban by U.S. Fish & Wildlife is grossly understated.

• The proposed ban would make the survival of cultural and historic artifacts much more unlikely, and keep them out of collections where they would be preserved. It is highly likely that the ban and regulations are against the National Historic Preservation Act of 1966. (See www.nps.gov/history/local-law/nhpa1966.htm.)

• Even the author of the African Elephant Conservation Act of 1989 testified at a congressional hearing on June 24, 2014, that this ban will not help to stop poaching and was never the intent of the AECA. (See www.fws.gov/international/laws/aeca_fv.html.)

• The current requirements for the antique exemption for export are still virtually impossible to meet for many legally obtained items due to a lack of documentation never previously required to stay with the instruments.

• Ideally, ivory regulations should revert to where they were on February 1, 2014, which did indeed stabilize elephant populations since their inception.

 

This is one of those times when we all need to stand up for what is right and fair. Somehow we need to get the powers in charge to understand that not one elephant will be saved by these absurd regulations, but our cultural, historical, and musical heritage will suffer, as will private individuals and owners of small businesses.

Kansas Congress Report

In the spring of 1854 the Massachusetts legislature chartered the New England Emigrant Aid Company, whose mission was to promote the settlement of Kansas by people who opposed slavery. Among the towns founded under its direction was Lawrence, and it was there that the University of Kansas was established. Central to its lovely campus, located on Mount Oread, is the World War II Memorial Campanile with its carillon.

Hosted by University Carillonneur Albert Gerken and the University's Department of Music and Dance, 132 individuals participated in the 55th Congress of the Guild of Carillonneurs in North America, June 3-7, 1997, which celebrated the instrument's restoration and with it the lives and contributions of four individuals whose careers as composers are inextricably linked to the carillon and to the University. Honored were Ronald Barnes, Roy Hamlin Johnson, John Pozdro and Gary White, who took inspiration from the magnificent Taylor carillon and contributed to the profession beyond words. Through recitals and presentations, the delegates, representing Australia, Belgium, Canada, England, The Netherlands and The United States of America, witnessed in glorious measure the significance of those contributions and of the instrument that inspired them.

John Gouwens played the opening recital, which included two compositions commissioned by the GCNA: Figments (1982) by Gary White, and Easter Dawning (1992) by George Crumb. Albert Gerken, like Gouwens, featured each of the four composers being honored, and premiered two works: Roy Hamlin Johnson's Winter Fanfares (1996), commissioned by the Department of Music and Dance and dedicated to Gerken, and Winds of Autumn, by John Pozdro. Other recitalists were Robert Byrnes, Don Cook, Bill De Turk, David Hunsberger, Karel Keldermans, Brian Swager, and Sally Slade Warner.

Six individuals were accorded Carillonneur status by vote of the Guild after playing successful examination recitals: Elaine Brewer, a Lawrence, Kansas freelance harpist; Helen Hawley, Organist/Choir Director at Plymouth Congregational Church, Lawrence; Rosemary Laing of Victoria, British Columbia, who is Carillonneur of the Netherlands Centennial Carillon, Organist at First Church of Christ, Scientist, and Music Specialist at the University of Victoria; Patrick Macoska, Organist/Choirmaster at St. Mary's of Redford, Detroit, Michigan; Suzanne Magassy, Carillonneur at the National Carillon, Canberra, Australia, and the only person outside of North America  to have become a Carillonneur member of the GCNA; and Gloria Werblow, Carillonneur at the Rainbow Tower Carillon, Niagara Falls, Ontario, and Carillonneur/Handbell Director at Calvary Episcopal Church, Williamsville, New York.

Presentations were enlightening and enjoyable. Mark Holmberg provided a historical overview of the KU carillon. Don Cook conducted a presentation/discussion on carillon music that meets pedagogical needs. Karel Keldermans described Gillett and Johnston's impact on carillon design in North America, focusing on the Rockefeller Chapel instrument at the University of Chicago. Brian Swager continued his description, begun in a Cohasset presentation, of baroque performance practice for carillonneurs, while Bill De Turk, anticipating his own recital, discussed the work of Samuel Barber, Gian-Carlo Menotti and Nino Rota while composers-in-residence at Bok Tower. In a session on Russian campanology, Edward Williams reviewed some of the more spectacular projects of Russian bellfounders.

George Gregory, joined in performance by Guild volunteers and KU music faculty, demonstrated the use of cup-shaped bells. John Pozdro led a session on composing, Andrea McCrady offered suggestions on how to play the carillon so as to avoid injury, and Roy Hamlin Johnson recalled his early efforts to learn how to compose for the carillon. Two new instruments were highlighted in illustrated presentations:  Margo Halsted introduced the Lurie Carillon, located on the north campus of the University of Michigan, Ann Arbor; and Beverly Buchanan described the Carillon Beach instrument, located at Panama City, Florida. Milford Myhre and Ronald Barnes gave a master class. There were tours of the Reuter Organ Company, and two KU students performed on the recently completed Wolff organ in the new Bales Recital Hall. John Agraz, Arla Jo Anderton, and John Courter were elected board members at-large.

Meeks and Watson hosted a welcoming reception, and Schulmerich hosted a closing ice cream social at the Campanile. The John Taylor Bellfounders hosted a candlelight buffet at the Dyche Natural History Museum. The Verdin Company hosted the annual pizza party at historic Liberty Hall, with entertainment by the Chuck Berg Quartet. The Royal Eijsbouts Bellfounders hosted the Congress banquet at KU's Adams Alumni Center, after which Bert Gerken formally introduced and thanked Ron Barnes, Roy Johnson, John Pozdro, and Gary White.

The World War II Memorial Carillon and Campanile, inspired by the memories of classmates, teachers, friends, and relatives, stands as the most outstanding visual symbol of the University of Kansas.

In 1945, Kansas Supreme Court Justice Hugo T. "Dutch" Wedell, secretary of the Kansas Alumni Association Fred Ellsworth, Chancellor Deane W. Malott, and their tireless volunteers began a campaign which would raise $343,000 from 8,000 individuals to build KU's memorial to its war dead, the 276 students and faculty whose names appear in the Memorial Room of the Campanile, and to additional individuals in whose memory bells and donations were given. Through many people's efforts, the World War II Memorial Carillon and Campanile was constructed. The Belgian Anton Brees, then carillonneur at Lake Wales, Florida, and Duke University, played the dedicatory recital to over 7000 listeners on May 27, 1951. Thus, KU became one of the first universities in the nation to complete a major World War II memorial. An inscription in the Memorial Room at the base of the tower reads: "Free government does not bestow repose upon its citizens, but sets them in the vanguard of battle to defend the liberty of every man."

The Campanile is 120 feet tall and made of native Kansas limestone quarried in Cottonwood Falls and Junction City. It was inspired by a plan by Olin Templin and designed by Kansas City architects Homer F. Neville (class of '22) and Edward B. Delk. The fifty-three bronze bells were cast by the John Taylor Foundry in 1950 and range in weight from 12 pounds to 13,490 pounds. The bourdon is keyed to G and sounds F-sharp. Frank Godfrey supervised the design, casting, and installation of the KU bells.

State of Kansas funds provided for maintenance of the Campanile structure itself, but there was never a maintenance fund for the musical instrument inside. Because the carillon received only minimal maintenance after the day of its dedication in 1951, use and time took their toll. By 1991 the carillon had fallen into disrepair, with no funds available for restoration. Deterioration was so extensive that the cost for repair had risen to $425,000. It needed new playing and practice consoles, new bell clappers and hardware, an entire new mechanical action, and a bell frame.

Fortunately for the beloved campus landmark and everyone who cherished it, Keith and Joan Bunnel, of Pittsburgh, Pennsylvania, contributed the entire $425,000, because they cared deeply about the carillon and those to whom it was dedicated.

The bells were silenced in 1993 to begin renovation. The Verdin Company of Cincinnati performed the work, and the new consoles were supplied by Meeks, Watson, & Company. That same year, former Chancellor Deane Malott of Ithaca, New York, agreed to lead a campaign to establish a $200,000 endowed maintenance fund that will provide annual inspection and upkeep of the carillon, in order to avoid the same deterioration that occurred in the first forty years. With Malott's leadership and the inspiration of the Keith and Joan Bunnel gift, nearly one thousand alumni responded to the call, exceeding the campaign's goal and ensuring that the KU carillon remains in perfect condition forevermore.

Ronald Barnes was University Carillonneur from 1951 to 1963 during which period the instrument was influential in the development of a North American school of carillon composition. Primary in this movement were KU composers Roy Hamlin Johnson, John Pozdro, and Gary White.

The University Carillonneur since 1963 has been Professor Albert Gerken of the KU Department of Music and Dance in the School of Fine Arts. Gerken supervised the entire carillon renovation and played the rededication on April 26, 1996.
